A LAWMAKER SUES PRESIDENT MUHAMMADU BUHARI

A member of the House of Representatives in Nigeria has sued President Muhammadu Buhari  for granting a bailout to states, insisting that the decision was ‘unconstitutional, null and void’.
Muhammadu-Buhari--Nigeria-President
Honourable Igariwey Onwe filed the case with the Abuja High Court on Wednesday.
He is seeking to establish, whether the President can, by way of fiat, call for the appropriation and disbursement of public revenue from the distributable pool account to the Federal, State and Local Governments, without prescription from the National Assembly.
President Buhari had recently approved a 400 billion Naira bailout package to enable states pay salaries to their workers.
Joined in the suit alongside President Buhari are the Attorney General of the Federation and Minister for Justice and the Federal Ministry of Finance.
Others are the Revenue Mobilisation Allocation and Fiscal Commission, the Accountant General of the Federation and Auditor General of the Federation.

JONATHAN ESCAPED DEATH IN KATSINA

BY Leon Usigbe - Katsina

SECURITY forces, on Tuesday, averted what was potentially an ugly situation, as hundreds of supporters chanting ‘sai Buhari’ attacked the motorcade of President Goodluck Jonathan in Katsina.

A combined unit of soldiers and anti-riot policemen dispersed the supporters as they surged forward with the intent to attack the president and his delegation, as they visited the house of Hajia Dada, mother of the late President Umaru Yar’Adua in her residence at Yar’Adua Quarters, Katsina.

There was palpable tension as the president’s convoy drove past the area, with hundreds of Buhari supporters brandishing brooms, the APC symbol and welcoming the president with chants of  “sai Buhari,” while some could be heard calling Jonathan “arna,” an unbeliever.

The president was about to emerge from the residence of Hajia Dada when the crowd suddenly started to surge towards his convoy, but the timely intervention of the security forces who fired canisters of tear gas provided cover for the convoy to speed away.

As the convoy sped towards the Katsina Airport, the crowd hurled stones at it, but nobody was hurt in the motorcade.

With the president were Vice President Namadi Sambo, national chairman of the Peoples Democratic Party (PDP), Alhaji Adamu Mu’azu, Governor Ibrahim Shema of Katsina State, ministers, other top members of PDP leadership, among others.

As the president’s aircraft took off for Abuja, members of his advance party staying behind were advised to hide their identity, in...

LOCUS STANDI: A HINDERANCE TO THE VIGILANT

PRITCHARDS O. OSARIEMEN (LLB UNIBEN)

Introduction
The right of the complainant to institute court proceedings, locus standi, is one of several consideration of the appropriateness or inappropriateness of the subject matter of litigation for judicial consideration. Any question of justiciability is addressed by the court before it proceeds to a consideration of the merits of any claim. Thus, locus standi is a condition precedent to any hearing of an alleged cause of action. The term locus standi denotes legal capacity to institute proceedings in a court of law and is used interchangeably with terms like “standing” or “title to sue”.1 It had also been defined as the right of a party to appear and be heard on the question before any court or tribunal.1 It is the “the right or competence to institute proceedings in a court for redress or assertion of a right enforceable at law”.1 It has also been stated that a party prosecuting an action would have locus standi, where the reliefs claimed would confers some benefits on such party.1
In this work, the writer undertakes to analyze the practice of locus standi in Nigeria, and the need for judicial and legislative intervention with a view to reducing its harshness.
The doctrine of locus standi over the years had been a major concern in the consideration of the merits of plethora of cases in Nigeria. At this, one would wonder whether Nigerian courts that preach against the sacrifice of justice on the altar of technicality are only paying lip services.

1000 PDP MEMBERS JOIN APGA IN ABIA

Information coming out of Abia State, eastern Nigeria suggests that at least 1,000 membersof the Peoples Democratic Party (PDP) have defectedto the All Progressives Grand Alliance(APGA) in Ukwa West Local Government Area.
A chieftain of APGA in Abia state, Chief Mark Anaba, made this revelation while he was receiving the defectors at Obehie, saying with the stream of defections of members of other political parties in Abia State to APGA, the party was poised to win next year's governorship election.
Anaba also stated that their aim is to win next year's governorship election in the state and to give Abia people a purposeful administration.
He noted thatAPGA would not be discouraged in its ambition to institute the desired change in the politics of the state in 2015.
Chief Anaba urged both old and new members of the party to work collectively to ensure that APGA, which he described as the only hope for Ndigbo, won the next governorship election in the state.
Mr. Evans Adiele, who was the Spokesman of the defectors, stated that they left PDP to APGA with the belief that their new party would provide what PDP could not provide for the people.
"It is regrettable that since the former governor, Chief Orji Uzor Kalu left office,my area has not witnessed the impact of governance in this area. Our standardof living has dropped in the last eight years and yet, we are an oil-producing area.
"We plant crops and produce foods, but we cannottransportthese crops to the urban areas because our roads are bad. We have many oil wells, yet our people are suffering in penury," he said.
A former local government chairman, Sylvanus Nwaji, also stated that the people of the area had been treated as slaves and strangers in their land in the last eight years.
